Users are strongly advised to thoroughly verify and evaluate all pertinent information before initiating any payment transactions or engaging in consultations with astrologers/consultants via the Code Mingle platform. Code Mingle expressly disclaims any responsibility, liability, or obligation arising from or related to users' payment transactions and consultations with astrologers/consultants, including, but not limited to, the accuracy, quality, or utility of the advice provided. As such, Code Mingle shall not be held accountable or liable for any losses, damages, or consequences, whether direct, indirect, or incidental, resulting from users' payment transactions or consultations conducted on the platform.

USER AGREEMENT

By agreeing to these Terms of Usage, Users also provide unconditional consent for the Website to arrange a call with them on their mobile numbers, even if their numbers are registered on the Do Not Disturb (DND) service provided by their mobile service providers.

All interactions on this Website, including guidance and advice received directly from the Licensed Provider, must comply with these Terms of Usage.

Users shall not post or transmit any material on the Website that violates or infringes upon others' rights, is unlawful, abusive, defamatory, invades privacy, vulgar, obscene, profane, or is otherwise objectionable, or encourages conduct that may lead to criminal offenses, civil liabilities, or other violations of the law.

The Website may suspend or terminate a User's access, registration, or future usage of the Website if the Website determines such User has violated these provisions.

The Website reserves the right to modify, discontinue, or change any aspect or feature of the Website, including content, graphics, deals, offers, and settings.

Any information received from Third-Party Service Providers, besides guidance and advice, including educational, graphical, research sources, and other incidental data on our website, myastroadvise.com and app, myastroadvise, should not be regarded as medical advice.

Myastroadvise does not guarantee the accuracy of any medical advice provided by third-party service providers, including registered astrologers on the site. It is always advised that users consult with a qualified healthcare professional for diagnosis and treatment, including information about which medications or treatments may be suitable for them. We do not represent or warrant that any specific medication or treatment is safe, appropriate, or effective for any user. Additionally, myastroadvise does not endorse any specific tests, medications, products, or procedures.

Myastroadvise does not guarantee the prevention of any adverse incidents that may occur after utilizing the Service. We are not liable or responsible for any unmet expectations of the user or any unexpected results. Accessing our website and using our services is solely at the user's risk.

By using our website, application, or services, users agree that any legal remedy or liability sought for actions or omissions by other members, including registered service providers or third parties associated with the website, will be limited to claims against the particular party causing the harm. Users agree not to attempt to impose liability on or seek legal remedy from myastroadvise in relation to such actions or omissions.

USER ACCOUNT ACCESS

The Website, its employees, agents, and other appointed individuals may access the User's account and information for the purpose of ensuring and maintaining high-quality services and addressing customer needs effectively. The User hereby agrees to grant unconditional access to their account by the Website. To address any received complaints or suspected abuse, the Website will conduct case-by-case investigations using available records. Users are advised to read the Privacy Policy regarding such records.

PRIVACY POLICY

By using the Website, the User acknowledges that they have read and fully understand the Privacy Policy and accept its terms and conditions, including any updates or modifications displayed on the Website.

BREACH AND TERMINATION

Without notifying the User, the Website may modify, discontinue, change, or alter services ordered or the User's registered Account, at its discretion, and may or may not provide a reason for such actions.

Any violation of the Terms of Usage may result in the immediate cancellation of the User's registration with the Website. The Website reserves the right to terminate and initiate action immediately if:

  - The Website is unable to verify and authenticate the User's registration data or any other relevant information.

  - The Website believes that the User's actions may lead to legal liability for the Website, other Users, or any linked service provider.

  - The User has provided false or misleading registration data, interfered with other Users or the administration of services, or violated the Privacy Policy.

Regarding Service Providers, including Astrologers, it is understood and agreed that their relationship with the Website is limited to being a member, and they act solely on their behalf and for their benefit. The Website may terminate and deactivate a Service Provider's profile for any violation of the Terms of Usage and the agreed-upon Service Terms and Conditions during their registration process.

TERMS REGARDING DELIVERY, CANCELLATION, AND REFUNDS

No refunds will be processed for any report orders if they have already reached the "processing" stage (assigned to an astrologer). Users bear the responsibility for hastily or carelessly placed orders, and MyAstroAdvise Platform will not be held accountable for refunds in such cases.

Refunds will not be processed for completed orders. However, if a user wishes to cancel an order before it is executed, they must contact customer care within one hour of payment. The decision to issue a refund lies at MyAstroAdvise Platform's discretion.

Technical delays or glitches in processing requests, including report generation by astrologers, do not qualify for refunds. Users acknowledge that timelines are approximate and all necessary steps will be taken to adhere to the displayed timelines.

No refunds will be processed if incorrect information is provided by the user. Users are advised to double-check the information they provide before submitting it. Any request for changes in incorrect information must be made through customer care within one hour of service execution.

No refunds will be processed for returned damaged products. It is the user's responsibility to handle products carefully after delivery. Cash on Delivery orders will incur charges for product cost and applicable shipping/custom/courier costs if the product is returned.

Refunds may be considered on a pro-rata basis for delays in subscription service activation, and any damage caused during transit will be addressed by MyAstroAdvise Platform and its agencies.

Users acknowledge that product display pictures are for reference purposes only, and MyAstroAdvise Platform will attempt to deliver products as closely to the displayed image as possible. No refunds will be issued based on slight product differences.

Services and products offered are not intended to replace philosophical, emotional, or medical treatment. MyAstroAdvise Platform is not responsible for the effectiveness of astrological products and holds no liability for their effects on human physiology. Users should exercise discretion, and no refunds will be granted on these grounds.

No refunds will be issued for providing an incorrect contact number for the "Call with Astrologer" feature. Users should ensure their contact number is correct and available when expecting a call. No refund will be issued for calls that are successfully connected.

Any refunds that are processed will deduct applicable transaction charges, shipping/courier costs, customs duties, and other incurred expenses.

In case of server-related issues, such as slowdowns or failures, on MyAstroAdvise Platform or the linked payment gateway, users are advised to double-check whether their bank account has been debited before initiating a second payment. Refunds for multiple payments against the same order will be processed in full, excluding transaction charges.

MyAstroAdvise Platform reserves the right to refuse or cancel any order for any reason. If an order is canceled after payment, the paid amount will be refunded.

By requesting a refund, users give permission for MyAstroAdvise Platform's quality audit team to access chat/call recordings related to the consultation under question. Refunds to be processed in up to 72 hours and will be credited to the user's MyAstroAdvise Wallet.

Refunds will be considered for issues such as network problems during chat/call, language fluency discrepancies, lengthy response times from consultants, and irrelevant or inappropriate responses to user queries.

Note: Refunds will not be given for consultation accuracy issues. MyAstroAdvise Platform is not responsible for the accuracy of consultations.

USER OBLIGATIONS

Users, including both astrologers and Member Customers, are obligated to adhere to the privacy policy, terms and conditions, and any other applicable terms on the Website. Users represent that they are individuals, not corporations or other legal business entities. The right to use the Website's services is personal to the User.

The User must not violate any terms and conditions while utilizing the Website or participating in any form of communication on any of the included forums, such as:

Users must not post, publish, or transmit any messages that are false, misleading, defamatory, harmful, threatening, abusive, harassing, defamatory, invasive of another's privacy, offensive, promoting racism, hatred or harm against any individual or group or religion or caste, infringing on another's rights, including any intellectual property rights or copyrights or trademarks, or encouraging any activity that would violate any applicable laws or regulations or give rise to civil liability.

Users must not upload, post, or make available any content they do not have the legal right to share, under any law or contractual or fiduciary relationship.

Users must not upload, post, or make available any content that infringes on any patent, trademark, trade secret, copyright, or other proprietary rights of any party. However, users may post excerpts of copyrighted material so long as they adhere to Fair Use guidelines.

Users must not collect screen names and email addresses of registered members for purposes of advertising, solicitation, or spam.

Users must not send unsolicited email, junk mail, spam, or chain letters, or engage in promotions or advertisements for products or services.

Users must not upload or distribute files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of the Website or another's computer.

Users must not participate in any activity that interferes with or disrupts access to the Website.

Users must not attempt to gain unauthorized access to any portion or feature of the Website, any other systems or networks connected to the Website, or any of the services offered on or through the Website, by hacking, password mining, or any other illegitimate means.

Users must not violate any applicable laws or regulations for the time being in force within or outside India. The use and ongoing use of the Website is subject to, but not limited to, using the services for personal use.

Users must not resell or make any commercial use of the Services without the express written consent of the Website.

By becoming a Registered member of the Website, the User agrees to various situations, including, but not limited to:

However, if uncontrollable circumstances arise, the Website reserves the right to issue a written warning. Repeated violations by the User may result in a total ban from the platform. If any balance remains in the User's wallet, it may not be refunded, subject to any applicable charges for such violations.

ACCOUNT INFORMATION FOR BANKING

The user is required to provide bank account information when necessary. The user's obligations in this regard include:

The user agrees to provide accurate and correct debit/credit card information for the use of the designated services, ensuring that they are using a debit/credit card that they lawfully own or have been authorized to use by the legitimate card owner. The user also commits to supplying genuine and valid debit/credit card information.

The user may pay fees to the website through debit/credit card transactions or an online banking account. By initiating payment or issuing an online payment instruction while providing bank/card details, the user confirms that:

    - They are legally entitled to use the specified debit/credit card or bank account for such transactions;

    - They will ensure that the provided card/bank account details are precise;

    - They will confirm that there is sufficient credit available on the selected card/bank account when making payments, including any applicable fees, to cover the dues payable or the selected bill(s).

Astrological advice given through the Website is based on the combined or individual knowledge, experience, and interpretations of astrologers, and therefore may vary between astrologers.

The Website offers services from a diverse group of astrologers who have been duly verified by the Website. These Service Providers (Astrologers) may recommend the use of mantras, yantras, gemstones, or other astrological remedies for the User's benefit. Such recommendations are made in good faith, but the Website and its subsidiaries, affiliates, officers, employees, agents, partners, and licensors do not warrant that:

  - the service will fulfill your expectations

  - the service will be uninterrupted, timely, secure, or error-free

  - the outcomes obtained from using the service will be precise or dependable

  - the standard of any products, services, information, or other material bought or procured by you via the service will live up to your expectations, and

  - any errors in the software will be fixed. It is your responsibility to disclose comprehensive information about the emotional, mental, and physical condition of the person seeking advice from the Website's panel of astrologers, enabling them to make an informed judgment when providing guidance.

The Website, its services, and all other materials are offered on an "as is" basis, with no warranties of any kind, express or implied, legal or otherwise, such as implied warranties of title, non-infringement, merchantability, or fitness for a particular purpose. The advisors/consultants/astrologers are registered members of the site but not employees of the Website or the company. While the Website verifies advisors' degrees, qualifications, credentials, and background, it does not recommend, endorse, verify, evaluate, or guarantee their advice, information, or other services, nor does it guarantee the validity, accuracy, completeness, safety, legality, quality, or applicability of their content, statements, or advice.

This Website is not a suicide helpline platform. If a User is considering suicide or believes they pose a danger to themselves or others, they should discontinue using the services immediately and contact appropriate law enforcement or emergency medical personnel. Regardless of any contrary provisions herein, MyAstroAdvise's liability to the User for any reason and in any form of action will always be limited to the amount paid, if any, by the User to the Website for the service during the term of membership.

INDEMNIFICATION

The User agrees to indemnify, protect, and hold harmless the Website and its parent, subsidiaries, affiliates, officers, directors, employees, suppliers, consultants, and agents from any and all claims, liabilities, damages, and/or costs (including, but not limited to, attorney’s fees) arising from their use of the Services, violation of the Privacy Policy or these Terms of Service, or infringement of any third party's rights, including without limitation, any intellectual property or other rights of any individual or entity. These Terms of Service shall benefit the Website’s successors, assigns, and licensees.

CONTENT OWNERSHIP RIGHTS

The User acknowledges that the Content, including but not limited to text, software, music, sound, photographs, video, graphics, or other materials featured in sponsor advertisements or distributed via email, commercially produced information presented to the User by the Website, its suppliers, and/or advertisers, are protected by copyrights, trademarks, service marks, patents, and/or other proprietary rights and laws. The User is not allowed to copy, use, reproduce, distribute, perform, display, or create derivative works from the Content unless explicitly authorized by the Website, its suppliers, or advertisers. Furthermore, content such as images, text, designs, etc., on all of the Website's portals are sourced from various online platforms such as Google Images. The Website or its parent company is not liable for any copyright infringement of the content or data.

Notices will be considered received 24 hours after sending an email, or 3 days after being deposited in the postal mail, to the User at the address they have provided in the Registration Data and to the Website at its designated address.

Our app strictly prohibits users from creating, uploading, or distributing any content that contributes to the exploitation or abuse of children, leading to the immediate deletion of the associated account. Our platform is committed to protecting the safety of children and will not tolerate any activities that endanger their well-being. This includes, but is not limited to, utilizing the Code Mingle app to promote predatory behavior toward children, such as:

Inappropriate interactions aimed at a child (e.g., touching or stroking inappropriately).

Grooming a child (e.g., developing an online relationship to facilitate sexual contact, either online or offline, and/or exchanging explicit images with the child).

Sexualizing a minor (e.g., displaying, encouraging, or promoting the sexual abuse of children or portraying children in a manner that could lead to their sexual exploitation).

Sextortion (e.g., intimidating or blackmailing a child by using actual or alleged access to the child's intimate images).

Trafficking a child (e.g., advertising or soliciting a child for commercial sexual exploitation).

If we become aware of any content that includes child sexual abuse materials, we will take appropriate action.

Furthermore, content that may be attractive to children but features adult themes is strictly prohibited, including but not limited to:

Content involving excessive violence, bloodshed, and gore.

Content or behaviors attempting to threaten or exploit people sexually, such as creepshots, hidden cameras, non-consensual sexual content created via deepfake or similar technology, or assault content.

Hate Speech

We prohibit users from promoting violence or encouraging hatred towards individuals or groups based on attributes such as race, ethnicity, religion, disability, age, nationality, veteran status, sexual orientation, gender, gender identity, caste, immigration status, or any other characteristic linked to systemic discrimination or marginalization. Common violations include:

- Content or speech claiming that a protected group is inhuman, inferior, or deserving of hatred.

Violence

We do not permit apps that depict or enable gratuitous violence or other dangerous activities. Common violations include:

- Graphic representations or descriptions of realistic violence or violent threats toward any person or animal.

- Content promoting self-harm, suicide, eating disorders, choking games, or other actions where serious injury or death may result.

Terrorist Content

We do not allow terrorist organizations to publish content for any purpose, including recruitment. We prohibit users with content related to terrorism, such as content that promotes terrorist acts, incites violence, or celebrates terrorist attacks.

Dangerous Organizations and Movements

We do not permit movements or organizations that have participated in, prepared for, or claimed responsibility for acts of violence against civilians to publish content for any purpose, including recruitment. We prohibit users with content related to planning, preparing, or glorifying violence against civilians.

Sensitive Events

We do not allow content that exploits or is insensitive towards sensitive events with significant social, cultural, or political impact, such as civil emergencies, natural disasters, public health emergencies, conflicts, deaths, or other tragic events. Common violations include:

- Insensitivity regarding the death of a real person or group due to suicide, overdose, natural causes, etc.

- Denial of a well-documented, major tragic event's occurrence.

- Appearing to profit from a sensitive event without any apparent benefit to the victims.

Bullying and Harassment

We do not permit content that includes or promotes threats, harassment, or bullying. Common violations include:

Targeting victims of international or religious conflicts with bullying.

Content that aims to exploit others, such as extortion or blackmail.

Sharing content with the intention of publicly humiliating someone.

Harassing those affected by a tragic event, or their friends and family members.

Dangerous Products

We prohibit users from promoting the sale of explosives, firearms, ammunition, or certain firearm accessories. We also disallow users from providing instructions on manufacturing such items, including converting firearms to automatic or simulated automatic capabilities.

Psychotropic Drugs

We forbid users from promoting the sale of marijuana or marijuana products, regardless of their legal status. Promotion of tobacco sales (including e-cigarettes and vape pens) and encouraging illegal or inappropriate use of alcohol or tobacco is also not allowed. Users may not promote the sale of psychotropic drugs or drugs that fall under the restricted category of the Drugs and Cosmetics Act and Rules 1945.

Black Magic, Witchcraft, Voodoo, and Tantra

We strictly prohibit users from engaging in any form of black magic, witchcraft, voodoo, or tantra. If we discover that a user is involved in such activities, we reserve the right to delete their account.

We cannot assure that the information available on or through MyAstroAdvise will be correct, accurate, timely, or reliable. We reserve the right, at our sole discretion, to edit or delete any documents, information, or other content appearing on the Site. Code Mingle IT Solutions reserves the right to modify or discontinue, temporarily or permanently, the Services and/or Sites (or any part thereof) with or without notice at any time and from time to time. Code Mingle IT Solutions shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service or any Sites.

JURISDICTION AND APPLICABLE LAW

Any disputes, claims, or controversies arising from or related to these Terms of Usage, including determining the scope or applicability of these Terms of Usage to arbitration, or your use of the Application or information it provides, will be resolved through arbitration in India with a single arbitrator mutually chosen by both parties and the Website. The arbitration will be in accordance with the Arbitration and Conciliation Act, 1996, and held in Pune with all proceedings, including any awards, in the English language. The decision will be final and binding for all parties involved.

Notwithstanding the above, either party may seek interim or preliminary relief from a competent court in Pune to protect their rights while awaiting the completion of arbitration. Both parties agree to submit to the exclusive jurisdiction of Indian courts with the venue in Pune for any such actions. If a party commences an action contrary to this provision, the other party may recover attorney fees and costs up to INR 100,000.

These Terms of Usage will be governed and interpreted in compliance with Indian laws, without considering any choice of law principles that may require applying the laws of another state. If a competent court finds any provision or part of these Terms of Usage or Privacy Policy unenforceable or invalid, that provision shall be altered and interpreted to best achieve the aims of the unenforceable or invalid provision within the bounds of applicable law, and the remainder of the Terms of Usage or Privacy Policy will remain in full effect. Section headings are for reference purposes only and do not define, limit, construe, or describe the scope or extent of each section. A waiver of any provision in the Terms of Usage is valid only if it is in writing and signed by MyAstroAdvise Platform. These Terms of Usage constitute the complete agreement between the parties regarding the subject matter and supersede any previous or concurrent agreements, both written and oral.

These Terms of Usage and your use of the Services are governed by Indian law, excluding its rules on conflict of laws. The parties agree to submit any disputes arising under these Terms of Usage to the jurisdiction of a court located in Pune for actions where the parties retain the right to seek injunctive or other equitable relief in a competent court to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.
